Rise & Shine Realty is committed to protecting your privacy. This policy explains how we collect, use, store and disclose your personal information, and works alongside the Privacy Disclosure Statement & Consent you sign and the Finsure privacy policy.

1. About this policy

Rise & Shine Realty ("we", "us", "our") provides mortgage broking (credit assistance) and buyer’s agent services. We operate as a credit representative under Finsure Finance & Insurance Pty Ltd (Australian Credit Licence 384704) ("Finsure"). We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and — because we arrange credit — Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code.

This policy works alongside the Privacy Disclosure Statement and Consent you sign as part of your application, and the Finsure Privacy Policy. Where they differ, the signed consent and Finsure’s policy govern the handling of your credit information.

2. What we collect

Depending on the services you use — including through our online client information form — we may collect:

  • Identity & contact details: name, date of birth, email, phone, addresses
  • Personal circumstances: marital status, dependants, nationality/residency
  • Financial information: employment, income, assets, liabilities, expenses, bank details
  • Credit information: obtained from a credit reporting body where you appoint us as your agent
  • Property & loan information: existing/proposed property, loan requirements, supporting documents
  • Verification documents: ID (licence/passport), payslips, bank statements
  • SMSF & trust information: trust/fund documentation and accountant confirmations

3. How & why we collect it

We collect information directly from you wherever practicable, and — where authorised or permitted by law — from third parties such as your accountant, referrers, lenders and credit reporting bodies. We use it to assess your needs and arrange finance, act as your agent to obtain credit information, prepare and submit applications, verify your identity, meet our legal obligations, and provide ongoing service. If you do not provide the information we request, we may be unable to assist.

4. Who we disclose it to

Consistent with the Privacy Disclosure Statement & Consent you sign, we and Finsure may exchange your information with:

  • persons who provide finance or other products to you, or to whom an application is made
  • financial consultants, accountants, lawyers and advisers
  • any industry body, tribunal or court in connection with a complaint
  • credit reporting bodies and prospective financiers, as authorised
  • our associates, related entities or contractors
  • your referees, such as your employer, to verify information
  • organisations providing online identity verification
  • any person where we are required or authorised by law

We do not sell your personal information.

5. Storing & protecting it

Your information is held by us and by Finsure. We take reasonable steps to protect it from misuse, loss and unauthorised access — including access controls, password protection and secure document transmission — and retain it only as long as necessary or as required by law.

6. Access, correction & complaints

You may request access to the personal information we hold and ask us to correct it. Contact us using the details below.
